Lamar Advertising Co., et al. v. Liberty Mutual Fire Insurance Co.
Barrasso Usdin won summary judgment for a major commercial property insurer dismissing a publicly-traded insured’s alleged multi-million dollar property damage and bad faith claims. In a decision issued on July 6, 2011, Judge Brady of the U.S. District Court for the Middle District of Louisiana agreed with the insurer’s argument that the property at issue was not covered under the policy because the insured failed to comply with the policy’s reporting requirements. Having rejected the insured’s claim for coverage, Judge Brady also found that the insured’s bad faith claim was “meritless” because the insurer “surely had a ‘reasonable basis’ for denying the disputed claim.”
