Louisiana Court Tosses All Claims Against Financial Advisor

The firm successfully defended a financial advisor against fiduciary duty, contract, and securities claims, obtaining pre-discovery dismissal of all claims with prejudice.

Our firm was retained to represent a financial advisor against claims for breach of fiduciary duty and breach of contract, as well as violations of Louisiana’s Blue Sky Law, in a succession dispute brought by a client’s heirs seeking to be named beneficiaries of an inheritance.  Plaintiffs’ complex petition for damages contained over 200 paragraphs alleging a fraudulent scheme among multiple defendants.  While other defendants unsuccessfully sought dismissal, after two rounds of briefing, the court dismissed our client with prejudice at the pleading stage, finding no liability.
