Barrasso Usdin Successfully Obtained Summary Judgment for Client

Barrasso Usdin won a victory at the Louisiana Fourth Circuit, dismissing lost profit claims against the firm's clients in connection with the construction of a large apartment building.  A neighboring business claimed that the inconveniences of construction—such as blocked traffic, sidewalks, and on-street parking, and lack of visibility of plaintiff’s business due to construction fencing and equipment—decreased its sales and caused hundreds of thousands in lost profits.  The district court dismissed the claim on summary judgment, and the Fourth Circuit affirmed.  The unanimous decision is a great precedent for property developers and great win for our clients.

Judy Y. Barrasso, Jamie L. Berger, Stephen R. Klaffky, and Lance W. Waters handled the matter.
