Barrasso Usdin Wins Dismissal with Prejudice of COVID-19 Business Interruption Insurance Claim

Judy Barrasso and Chloé Chetta won an impressive motion for judgment on the pleadings of a commercial plaintiff’s COVID-19 business interruption insurance coverage claims in Ohio state court.  Serving as national counsel for an international insurer, the firm successfully persuaded the Ohio court, faced with conflicting local decisions, to dismiss plaintiff’s coverage claims for lost business income and extra expenses due to the COVID-19 pandemic and resulting governmental stay-at-home orders.
