Barrasso Usdin Wins Another Dismissal of COVID-19 Business Interruption Insurance Claim

Judy Barrasso and Chloé Chetta won a motion for judgment on the pleadings of a commercial plaintiff’s COVID-19 business interruption insurance coverage claims in federal court in Los Angeles, California.  The court held that the policy does not cover business income losses and extra expenses due to the COVID-19 pandemic and resulting governmental stay-at-home orders.  The court also held that the virus exclusion in the policy precludes coverage in any event.
